New Delhi, Nov 16: The National Investigation Agency (NIA) Court in New Delhi has granted seven days of custody parole to Bilal Mir, an accused in an alleged terror-related case, to perform the last rites and related rituals following the death of his father, Ghulam Mohammad Mir, in Srinagar, Kashmir.

Principal District and Sessions Judge Vimal Kumar Yadav issued the order on Saturday, citing humanitarian grounds and the irreplaceable bond between a father and son. The parole will be effective from November 16, excluding travel time.

Key Highlights of the Order:

  1. Humanitarian Grounds: The court acknowledged the importance of family support in times of bereavement and emphasized that the applicant’s presence is essential to console and comfort his family.
  2. Custody Guidelines: During the parole period, Bilal Mir will remain lodged in the nearest Central Jail. He will be escorted to his residence during the day to perform the rituals.
  3. Security Measures: The court directed prison authorities to coordinate with local police and, if necessary, the NIA to ensure Mir’s safety and compliance with the conditions.
  4. Restrictions Imposed:

Mir can only meet close family members and pre-verified long-time friends.

Interaction with the public, press, or through digital communication is strictly prohibited.

Any violation of these conditions will result in an immediate termination of parole.

The court emphasized that the travel expenses would be borne by the applicant, with arrangements facilitated by the prison authorities.

Legal Arguments:

Advocate Kartik Venu, representing Bilal Mir, argued that his client, as the sole surviving son, is responsible for performing his father’s last rites according to Islamic customs. He requested interim bail of two weeks on humanitarian grounds, assuring compliance with all conditions.

The NIA opposed the plea, citing concerns about Mir’s alleged involvement in illegal activities. However, it agreed to custody parole for seven days instead of interim bail.

Court’s Considerations:

The court balanced the humanitarian need for family unity during bereavement with security concerns raised by the NIA. It reiterated the necessity of keeping detailed records of Mir’s movements and interactions to mitigate any risk to public safety or law and order.

This parole allows Bilal Mir to fulfill his familial and religious obligations while ensuring compliance with legal and security protocols.
